These Terms & Conditions govern your access to and use of Business Problem Solving, an AI-assisted business diagnostic platform operated by Wright & Grow Consulting LLP. By creating an account, accessing, or using the platform, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.

1. Introduction

These Terms & Conditions apply to your use of the platform, including account creation, AI-assisted diagnostic services, reports, recommendations, communication, payments, data handling, and all related platform interactions.

2. Platform Purpose

The platform provides AI-assisted business diagnostic tools, including question generation, diagnostic analysis, structured reports, root cause insights, solution recommendations, action plans, and related outputs derived from user-provided information.

3. Eligibility

You represent that you are legally capable of entering into a binding agreement and are using the platform for lawful business or professional purposes.

4. Account Registration and Security

  • You must provide accurate and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for activities that occur under your account.
  • You must promptly notify us of any unauthorized access or misuse of your account.

5. Acceptable Use

You agree not to:

  • use the platform for unlawful, fraudulent, harmful, or abusive purposes
  • attempt to disrupt, overload, reverse engineer, or compromise the platform
  • upload malicious code or unauthorized content
  • misrepresent your identity or impersonate others
  • use outputs as a substitute for licensed professional advice where such advice is necessary
  • interfere with platform operations, security, or other users

6. Information We Collect

We may collect the following categories of information:

  • Account Information: full name, email address, mobile / WhatsApp number, password hash, login metadata.
  • Business Profile Information: company name, industry, employee count, revenue band, ERP/CRM details, owner involvement, products/services summary, and other profile inputs.
  • Diagnostic Inputs: business problem selections, answers to diagnostic questions, uploaded or entered business information, and related operational inputs.
  • AI Report Data: diagnostic outputs, root causes, solutions, action steps, model metadata, token usage, report generation logs, and timestamps.
  • Technical Data: IP address, browser type, operating system, device details, session logs, usage data, error logs, and security logs.
  • Communication Preferences: service communication consent, marketing opt-in preference, unsubscribe status.
  • Payment / Billing Data: limited transaction metadata, order identifiers, and entitlement data.

7. How We Use Your Information

  • to create and manage user accounts
  • to authenticate users and maintain platform security
  • to generate AI-assisted business diagnostic reports
  • to save, display, export, and email reports to users
  • to respond to support requests and service issues
  • to improve product quality, stability, and usability
  • to prevent fraud, abuse, misuse, and unauthorized access
  • to comply with legal, tax, accounting, and regulatory obligations
  • to send service-related messages such as verification emails, report notifications, billing notices, and account alerts
  • to send marketing communications only where the user has explicitly opted in

8. Privacy, Data Processing, and Sharing

By using the platform, you consent to the collection, storage, and processing of your account details, business profile information, diagnostic responses, and technical usage data for platform operations, service improvement, security, support, compliance, and delivery of outputs.

We may share information with trusted service providers such as AI service providers, hosting and infrastructure providers, email delivery providers, analytics and monitoring providers, payment processors, and professional advisors where necessary. We do not sell your personal data as a standalone data asset.

9. AI Processing Disclosure

The platform uses artificial intelligence technologies to generate business diagnostic insights, summaries, root cause hypotheses, recommended solutions, and action steps based on user-provided inputs. Certain information you provide may be processed by third-party AI providers solely for the purpose of generating requested outputs and improving service delivery, subject to applicable contractual and technical safeguards.

10. AI-Generated Content and Risk Disclaimer

Outputs are generated automatically using machine learning systems and prompt-based processing of user-provided information. AI-generated outputs may contain inaccuracies, omissions, assumptions, outdated information, generalized recommendations, or content unsuitable for every business context.

Some platform features may rely on evolving or experimental AI technologies and may behave unpredictably or imperfectly.

11. Informational Use Only / No Professional Advice

The platform does not provide legal advice, tax advice, financial advice, accounting advice, investment advice, management consulting services, or any regulated professional advisory service. All outputs are for informational and educational purposes only.

12. Human Oversight Requirement

You acknowledge that AI-generated outputs require human judgment, review, and validation before implementation. You are solely responsible for deciding whether and how to use any output.

13. No Automated Decision-Making by the Platform

The platform does not make decisions on your behalf. Any business action, omission, hiring decision, restructuring decision, pricing action, strategy decision, financial decision, or investment decision taken after using the platform remains solely your responsibility.

14. User Responsibility for Input Data

You are responsible for ensuring that all data, facts, assumptions, business information, and responses submitted by you are accurate, lawful, and appropriate. Output quality depends materially on the completeness and accuracy of your inputs.

15. No Guarantee of Results

We do not guarantee business outcomes, financial performance, operational improvements, revenue growth, profit growth, cost reduction, employee productivity, market expansion, turnaround success, or any specific result from use of the platform.

16. Consent for Service Messages

By creating an account and using the platform, you expressly consent to receive service-related communications via WhatsApp, SMS, email, or phone call for purposes including but not limited to:

  • account verification
  • login and access support
  • report or output delivery
  • billing and payment communication
  • technical support and customer service
  • important service alerts and operational notifications

This consent is mandatory because such communications are necessary to deliver the platform service properly.

17. Marketing Communication

Marketing and promotional communications are sent only if you have separately opted in. You may unsubscribe from marketing communications at any time.

18. Cookies and Similar Technologies

The platform uses cookies and similar technologies for authentication, session continuity, security, analytics, and performance optimization.

Cookies may be used for essential authentication, session management, user preferences, performance analysis, security monitoring, and fraud prevention. Disabling essential cookies may affect platform functionality, login continuity, or security.

19. International Data Transfers

Because the platform may use global service providers, your information may be processed in India or in other jurisdictions where our service providers operate. By using the platform, you acknowledge and consent to such processing and transfers, subject to reasonable safeguards.

20. Data Security

We implement reasonable technical and organizational safeguards, including access controls, authentication measures, secure hosting practices, encryption in transit where applicable, logging, and role-based permissions. However, no system can guarantee absolute security.

21. Data Retention

We retain data only for as long as necessary for platform operation, legal compliance, dispute resolution, audit purposes, enforcement of agreements, and legitimate business needs.

Backup or archival copies may remain in secure systems for a limited time even after deletion requests, after which they are overwritten or removed in accordance with operational cycles.

22. User Rights

Subject to applicable law, you may request:

  • access to your data
  • correction of inaccurate data
  • deletion of your data
  • withdrawal of consent, where processing is consent-based
  • closure of your account
  • cessation of marketing communications

23. Applicable Privacy Compliance

For users in India, we seek to handle digital personal data in a manner aligned with the Digital Personal Data Protection Act, 2023, including consent-based processing, purpose limitation, reasonable security safeguards, and support for correction/deletion requests where applicable.

24. Children’s Privacy

The platform is intended for adult business users. We do not knowingly collect personal data from children.

25. Intellectual Property

The platform, software, workflows, design, prompts, systems, processes, trademarks, branding, and related intellectual property remain the property of Wright & Grow Consulting LLP or its licensors. You receive a limited, non-exclusive, revocable right to use the platform in accordance with these Terms & Conditions.

26. User Content License

You retain ownership of your business inputs and submitted content. However, you grant us a limited right to process, store, transform, analyze, transmit, and use such content solely to operate, secure, improve, and provide the platform and related services.

27. Service Availability

We do not guarantee uninterrupted availability. The platform may be unavailable due to maintenance, technical issues, third-party downtime, force majeure events, or other causes beyond our reasonable control.

28. Fees, Credits, and Digital Service Nature

Certain features may require payment, credits, or entitlements. Where applicable, once a digital diagnostic report has been generated and delivered, it is considered a consumed digital service.

29. Refunds and Cancellation

Due to the nature of digital and instantly consumable AI services, refunds are generally not available after successful generation and/or delivery of a diagnostic report or after credit consumption.

Refund requests may be considered in limited cases such as:

  • duplicate payment
  • billing error caused by the platform
  • technical failure where payment was collected but report generation was not completed and service was not delivered
  • other exceptional cases determined by us at our sole discretion

Refunds are generally not available in cases such as:

  • change of mind after report generation
  • dissatisfaction with business outcomes after implementing insights
  • disagreement with AI-generated recommendations
  • incorrect inputs submitted by the user
  • partial use of purchased credits or services

Refund requests, where eligible, should generally be made within 7 days of the relevant transaction. Cancellation stops future use but does not automatically entitle the user to a refund for services already delivered.

30. Limitation of Liability

To the maximum extent permitted by applicable law, Wright & Grow Consulting LLP, its partners, affiliates, directors, employees, contractors, licensors, vendors, and technology partners shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to:

  • use of or inability to use the platform
  • reliance on AI-generated outputs
  • business losses, lost profits, lost revenue, lost opportunities, or operational disruptions
  • strategic, managerial, employment, restructuring, or financial decisions
  • inaccuracies or limitations in AI-generated content
  • third-party service failure

31. Liability Cap

To the extent any liability is legally imposed, the total aggregate liability of Wright & Grow Consulting LLP shall not exceed the total amount paid by you to the Company for the platform during the twelve (12) months immediately preceding the event giving rise to the claim.

32. Indemnity

You agree to indemnify, defend, and hold harmless Wright & Grow Consulting LLP and its affiliates, personnel, and partners from claims, liabilities, losses, damages, costs, and expenses arising from:

  • your misuse of the platform
  • your violation of these Terms & Conditions
  • your unlawful or inaccurate inputs
  • your reliance on outputs without independent review

33. Suspension and Termination

We may suspend or terminate access where we believe there is misuse, fraud, non-payment, abuse, legal risk, security risk, or violation of these Terms & Conditions.

34. Changes to Service or Terms

We may change, suspend, or discontinue any part of the platform and may update these Terms & Conditions from time to time. Continued use after updates constitutes acceptance of the revised Terms & Conditions. The version accepted by you at the time of signup may be stored for compliance and audit purposes.

35. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of India. Courts located in Pune, Maharashtra, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms & Conditions or the platform.
